Terms of Service

1. Agreement

These Terms of Service ("Terms") are a binding agreement between you and verifications.email ("EVA", "we", "us") governing your use of the cloud email verification service at https://verifications.email, including the API, dashboard, and bulk verification tools (together, the "Service"). By creating an account or using the Service you accept these Terms, our Privacy Policy, and our Data Processing Addendum. The Service is intended for business use.

2. The Service

EVA analyzes email addresses you submit and returns verification verdicts, scores, and related metadata. Verification is inherently probabilistic: mail servers change behavior, use catch-all configurations, or decline to reveal mailbox status. Verdicts are informational estimates to support your decisions, not guarantees of deliverability. Checks we cannot complete definitively are marked unknown and are not charged.

3. Accounts and API keys

You must provide accurate account information and keep your credentials and API keys confidential. You are responsible for all activity under your account and keys. Notify us promptly at [email protected] if you suspect unauthorized use.

4. Acceptable use

You agree that you will not:

  • Use the Service to create, clean, or facilitate lists for unsolicited bulk email (spam) or any sending that violates applicable law, including CAN-SPAM, GDPR, and the ePrivacy rules.
  • Submit purchased, rented, scraped, or harvested email lists.
  • Submit any address you do not have a lawful basis to process. You warrant that a lawful basis exists for every address you submit.
  • Resell, redistribute, or publish raw verification results as a data product or database.
  • Reverse engineer the Service, probe its verification infrastructure, or use the Service to build a competing email verification product.
  • Circumvent rate limits, quotas, or security controls, or use the Service in any unlawful way.

We may suspend or terminate accounts that violate this section immediately and without refund.

5. Your data

You retain all rights to the email addresses and lists you submit. For personal data contained in them, you are the controller and we are your processor under the Data Processing Addendum, which is incorporated into these Terms. We never sell your lists, never use them for our own purposes, and never send mail to the addresses you check.

6. Fees and payment

  • Prices are quoted in US dollars. Payment is made in cryptocurrency through our self-hosted checkout. The crypto amount is fixed at invoice time; you bear network fees and exchange-rate movements after that moment.
  • Cryptocurrency payments are final and irreversible once confirmed on the network. Where we choose to issue a refund or goodwill adjustment, it is provided as account credit.
  • Subscriptions renew each billing period until cancelled. You can cancel at any time; cancellation takes effect at the end of the current period. Unused monthly quota does not roll over.
  • Pay-as-you-go credits do not expire while your account remains in good standing.
  • If you are a consumer in the EU or UK: by purchasing you expressly request immediate performance and acknowledge that once delivery of credits or service has begun, you lose the statutory 14-day right of withdrawal.

7. Sanctions and export compliance

You represent that you, and the organization you act for, are not listed on any US, EU, UK, or UN sanctions list and are not located in a comprehensively sanctioned jurisdiction. We may refuse, suspend, or terminate service and block associated payments where we believe continuing would violate sanctions or export laws.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DO NOT WARRANT THAT VERIFICATION RESULTS WILL BE ACCURATE, COMPLETE, OR ERROR-FREE, THAT ANY ADDRESS MARKED VALID WILL ACCEPT MAIL, OR THAT THE SERVICE WILL BE UNINTERRUPTED. YOU REMAIN SOLELY RESPONSIBLE FOR YOUR SENDING DECISIONS AND FOR COMPLIANCE WITH LAWS APPLICABLE TO YOUR EMAIL ACTIVITY. THE SERVICE PROVIDES INFORMATION ONLY AND DOES NOT CONSTITUTE LEGAL OR COMPLIANCE ADVICE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

10. Indemnification

You will defend and indemnify us against claims, damages, and costs arising from the lists and data you submit, your use of verification results, or your breach of these Terms, including any claim that you lacked a lawful basis to process a submitted address.

11. Suspension and termination

You may close your account at any time. We may suspend or terminate the Service for breach of these Terms (immediately, for breaches of section 4 or 7), for non-payment, or where required by law. On termination your API access ends; you may request deletion of your data as described in the Privacy Policy. Credits are forfeited where termination results from a breach of section 4.

12. Self-hosted licenses

Self-hosted and source-code licenses for the EVA engine are sold under separate written license agreements. These Terms govern the cloud Service only.

13. Changes to these Terms

We may update these Terms as the Service evolves. Material changes will be announced by email or dashboard notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
